This Class Action was aiming to obtain a declaration of nullity of a borrowing by- law of more than one million dollars adopted illegally by the municipality for the construction of a golf course outside the municipality territory.

Chronology
1984 : The motion for authorization to institute a Class action has been denied by the Superior Court and by the Court of Appeal on dissent. The dissenting opinion of Mr. Justice Amédée Monet has been quoted in many decisions since the Judge makes comments on the nature of the Class Action and more precisely on the Class Action as a way to give access to Justice.
