Notice to members – Pharmaprix Optimum_approval of a settlement in a class action (short form)

 

PHARMAPRIX OPTIMUM PROGRAM
CLASS ACTION

MODIFICATIONS MADE TO THE PHARMAPRIX OPTIMUM PROGRAM BETWEEN
MARCH 8, 2008 AND JULY 1, 2010

MEMBERS CAN RECEIVE SOME OPTIMUM POINTS
Option consommateurs instituted a class action against Pharmaprix. Options consommateurs claims that Pharmaprix illegaly lowered the value of the Optimum Program points in March, 2008; May, 2009; and July, 2010. The class action seeks to compensate the members of the Optimum Program for this alleged loss of value. Pharmaprix claims to be in compliance with the law. Option consommateurs and Pharmaprix negociated a settlement that will be submitted for approval by the Superiour Court of Québec on September 6, 2017.

WHAT IS THE PROPOSED SETTLEMENT?
Without any admission of liability, Pharmaprix will transfer the Optimum points directly to the accounts of the members touched by the settlement. The number of points received will depend on the number of points held during each of the modifications.
The total number of points agreed to in this settlement will be reduced to take into account the legal fees of the members of the Group. Those legal fees must be approuved by the court.

WHO MAY RECEIVE OPTIMUM POINTS?
You are a class member of the group if you meet the following conditions:
 You are a natural person residing in Québec;
 You were an active member of the Pharmaprix Optimum Program between March, 2008 and July, 2010; and
 You are currently an active member of the Pharmaprix Optimum Program;
 You are meeting the specific conditions disclosed in the settlement for at least one of the three modifications mentionned above.
There is no need for you to file a claim; the Optimum points will be transfered directly to your Optimum accounts.

HOW CAN I OBJECT TO THE SETTLEMENT?
If you would like to object to this settlement, you must attend the hearing that will be held on September 6, 2017, at 9 :30 a.m. in room 2.08 of the Montreal courthouse, located at 1 Notre-Dame Street East in Montreal.
